Fusion 41 - Application Procedure and Eligibility Requirements
I. Application Procedure
Each applicant must own any model year Ford Fusion, Fusion Hybrid, or Fusion Sport. All applications must be received by Friday, November 13, 2009 at 11:59:59pm EST.
II. Eligibility Requirements
Please note that the following eligibility requirements must be met in order to proceed with the application process:
a. Each applicant must submit a photo and complete an application form to participate in the Program.
b. If you are selected to proceed to the interview round, the dates and times of the finalist interviews will be sometime from video and/or application submission through early November 2009 and may be revised by TDI in its sole discretion.
c. Must be at least 21 years of age and be a United States citizen.
d. Each applicant must complete and submit a photo of themselves and application before being eligible to participate in the interview process. In addition, all applicants must complete, sign, and timely return a Finalist Agreement, Release and Waiver Agreement and additional documents before being permitted to participate in the Program. The additional required documents may include, but will not necessarily be limited to, Disclosure and Authorization for Background Reports, Authorization for Release of Records and Information and a Confidentiality Agreement (all of which will be furnished to the applicants). As part of the Release and Waiver Agreement, each applicant must agree to, among other things, assume the risk of any and all injury, illness, death, damage, loss, or harm to the applicant and/or applicant's property, howsoever caused, resulting from or arising out of the selection of participants, applicant's participation in the Program as a participant or otherwise, and/or the production and/or exploitation of the Program. By agreeing to the terms of the Confidentiality Agreement, each applicant will be required to, among other things, treat all information and material received or acquired in connection with applicant's participation in the participant selection process and Program (if selected as a participant), as strictly confidential. In connection with the Disclosure Authorization and Authorization for Release of Records and Information, all applicants must authorize the Program team to conduct such full and complete background checks of the applicant as the Program team, in their sole discretion, deem necessary or appropriate. The applicants will be required to cooperate fully with the Program Team in connection with such background investigations.
e. Applicants must disclose if they have ever been charged with a felony or misdemeanor, other than minor traffic or parking violations. The Program team reserves the right in their discretion to disqualify any applicant based on such disclosures or any other information obtained.
f. All participants must agree to abide by the user-generated content and headquarter reporting responsibilities associated with the program sharing their experiences with the vehicle. The Program team reserves the right in their discretion to disqualify any participant at any time based on lack of fulfillment of these obligations.
g. Employees, officers, directors, dealers and agents of Ford Motor Company or WPP affiliated and subsidiary companies and the immediate family or members of their same households (whether related or not) of such employees, and any person who is a member of the Screen Actors Guild or the American Federation of Television and Radio Artists, are not eligible to be participants on the Program or to participate in this application process.
h. The Program team also reserves the right to contact applicants to ask additional questions and/or conduct phone interviews to gather additional information about applicants. Such phone interviews are not required and are at the Program team's sole discretion to assist in gathering information for participant selection.
i. The Program team is not responsible for applications not received. Due to the high volume of anticipated applications, the Program team will not be able to answer any questions about the receipt or status of any application.
j. The Program team reserves the right to disqualify any applicant/selected participant for any reason at any stage of the Program
k. By submitting an application, each applicant agrees to release, discharge and hold harmless Ford Motor Company and WPP/TDI from all claims and damages arising out of his/her participation in the application process or the Program itself, and to have his or her name, voice and likeness used at the Program team's discretion as part of the Program, or as part of promotions arising out of or in connection with the Program, in any and all media now known or hereafter devised as further set forth in the Release and Waiver at the end of the application.
I hereby acknowledge that: (i) I have read, and I meet and agree to be bound by, the eligibility requirements; (ii) All information submitted in either the video and/or application is honest and accurate; (iii) if any of the above information is found to be false, this will be grounds for my dismissal from the selection process, and/or from the Program, if selected; (iv) even if I meet the eligibility requirements, I understand there is no obligation to interview me, and/or select me as a participant; (v) even if I am selected as a participant, Ford has no obligation to complete the Program, and (vi) all decisions by Ford concerning selection of the participants is final and not subject to challenge or appeal.
By submitting this application, I hereby consent to the recording, use and reuse by the TDI and Ford Motor Company and any of their respective licensees, assigns, parents, subsidiaries, divisions, business units, or affiliated entities and each of their respective employees, agents, officers and directors (collectively "Releasees") of my voice, actions, likeness, name, appearance and biographical material (collectively "Likeness") in any and all media now known or hereafter devised, worldwide, in perpetuity, in or in connection with the Program. I agree that Releasees may use all or any part of my Likeness, and may alter or modify it, regardless of whether or not I am recognizable. I further agree that Releasees may use my Likeness and the content developed and generated by the Program in connection with any promotion, publicity, marketing or advertisement arising out of or in connection with the Program in any manner whatsoever. I release Releasees from any and all liability arising out of its use of my Likeness and/or the Video. I agree not to make any claim against Releasees as a result of the use of my Likeness and/or the Video (including, without limitation, any claim that such use invades any right or privacy and/or publicity).
